We may collect and store information about your transaction when you place an order or make a purchase through the Website, mobile app, or in our stores, such as the items ordered, the transaction amount, the date and location of the store of your order, and limited payment information, such as payment card type, expiration date, and the last four digits of your card number; however, we do not collect or store whole payment card numbers, and our third-party payment processors process all payment card transactions.

Cookie Cutters is based in the United States, and as mentioned above, we use Shopify to power individual online stores to sell products available in the respective location. As such, we are subject to the Shopify Data Processing Addendum ("Addendum") amends the Shopify Terms of Service (the "Agreement") by and between Cookie Cutters and Shopify Inc., a Canadian corporation with offices at 150 Elgin Street, Suite 800, Ottawa, ON, K2P 1L4, on behalf of itself, its Singaporean affiliate Shopify Commerce Singapore PTE. LTD., and its Irish affiliate Shopify International Ltd. (collectively "Shopify").

If you are located in the European Economic Area (EEA), please note that Cookie Cutters does not intend to offer goods and services (including the Services) to EEA individuals. Security

Cookie Cutters takes reasonable measures to help protect information about you from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction.

Shopify, the data processor, encrypts data sent to and from merchants and customers using the HTTPS protocol. Shopify also encrypts any sensitive stored information and salts and hashes merchant and customer passwords using bcrypt.

Cookie Cutters may also set up additional security features such as Enabling multi-factor authentication for staff. Define, to a certain extent, what personal data is collected from customers. View certain activity logs, including recent login activity by staff. Set role-based permissions for staff accounts.

Cookie Cutters has picked Shopify as a web platform due to the robust, cross-functional organizational measures taken for data protection. Of which consists of Internal Security, Legal, Operations, Production Security, and Processing Integrity.

Security Standards and Certifications

Cookie Cutters online stores powered by Shopify are Level 1 PCI-DSS compliant.

Shopify uses third-party data centers with industry-standard certifications.

Examples include: Tier III, ISO 27001, PCI-DSS SOC reports for all facilities, including physical protection, and can be provided to Cookie Cutters on request under an appropriate NDA.

Shopify performs annual audits to ensure our handling of your credit card information aligns with industry guidelines. Additionally, the Shopify platform is audited annually by a third-party qualified security assessor.

No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee the absolute security of your personal information.

Your Options

Account Information. You may update, correct or delete account information at any time by logging into your account. If you wish to deactivate your account, please send an email to christie@haircutsarefun.com. Include your name, account name (if different), contact information, and a request to deactivate your account. Please note, however, that we may retain certain information that you provide through our Services as required or permitted by applicable law. We also may retain cached or archived copies of information about you for a certain period.

Any California residents under the age of eighteen (18) who have registered to use the Services and posted content or information on the Services can request removal by contacting Cookie Cutters, at 2365 E. Requests must include "California Privacy Rights Request" in the first line of the description and include your street address, city, state, and ZIP code. Requests must detail where the content or information posts and attesting that you posted it. Cookie Cutters will then make reasonable good faith efforts to remove the post from prospective public view or anonymize it so the minor cannot be individually identified to the extent required by applicable law. This removal process cannot ensure complete or comprehensive removal. For instance, third parties may have republished or archived content by search engines and others that Cookie Cutters does not control.

California Privacy Act Notice

Some Personal Information we maintain about Consumers is not sufficiently associated with enough personal information about the Consumer for us to be able to verify that it is a particular Consumer's personal information (e.g., clickstream data tied only to a pseudonymous browser ID). As required by the CCPA, we do not include that personal information in response to Verifiable Consumer Requests. If we cannot comply with a request, we will explain the reasons in our response. 

We will make commercially reasonable efforts to identify Personal Information that we collect, process, store, disclose, and otherwise use to respond to your California Consumer privacy rights requests. We will typically not charge a fee to respond to your requests fully, but we may charge a reasonable fee or refuse to act upon an appeal if your request is excessive, repetitive, unfounded, or overly burdensome. 

When you contact us to request, we will ask you to provide certain information that we will use to verify your identity. We will use the information you provide to determine if it matches our systems' data. We reserve the right to follow up and request additional information to verify your identity. For your specific pieces of information, as required by the CCPA, we may apply heightened verification standards. 

You have the right to send us a request, no more than twice in twelve months, for any of the following for the period that is twelve months before the requested date:

You may alternatively exercise more limited control of your Personal Information by instead exercising one of the following more limited opt-outs: commercial email opt-out or deletion of your Cookie Cutters account. 

We will not discriminate against you in a manner prohibited by the CCPA because you exercise your CCPA rights. However, we may charge a different price or rate or offer an extra level of quality of good or service to the extent that doing so is reasonably related to the applicable data's value. Besides, we may offer you financial incentives for the collection, sale, and retention, and use of your Personal Information as permitted by the CCPA that can, without limitation, result in reasonably different prices, rates, or quality levels. Any financial incentive's material aspects will be explained and described in its program terms if the program exists. Please note that participating in incentive programs is entirely optional; you will have to affirmatively opt-in to the program, and you can opt-out of each program (i.e., terminate participation and forgo the ongoing incentives) prospectively by following the instructions in the applicable program description and terms. We may add or change incentive programs and/or their terms by posting a notice on the program descriptions and phrases linked to above, so check them regularly.

Your Nevada Privacy Rights

Nevada residents may opt-out of the sale of certain "covered information" collected by operators of websites or online services under Nevada law. We currently do not sell covered information, as "sale" is defined by such law, and we don't have plans to sell this information. However, if you would like to be notified if we decide in the future to sell personal information covered by the Act, please contact christie@haircutsarefun.com and provide your name and email address in an email with "Nevada Data Privacy" in the subject. You are responsible for updating any change in your email address by the same method, and we are not obligated to cross-reference other emails you may have otherwise provided us for other purposes. We will maintain this information and contact you if our plans change. At that time, we will create a process for verifying your identity and providing an opportunity for verified consumers to complete their opt-out. We may share your data as explained in this Privacy Policy, such as to enhance your experiences and our services, and those activities will be unaffected by a Nevada do not sell request. Canadian Law

CASL and PIPEDA

Cookie Cutters complies with the Canadian laws known as the Canadian Anti-Spam Law (CASL) and the Personal Information Protection and Electronic Documents Act (PIPEDA).

An individual must voluntarily and proactively provide information to Cookie Cutters or its consultant(s) and the individual must always consent before Cookie Cutters collects, uses or discloses that individual's personal information. If the individual consents to providing contact information or consents to receiving electronic information from Cookie Cutters or its consultants, the individual may receive communications from Cookie Cutters or its consultants. The communications may include printed or electronic newsletters, email communications, invitations to visit the Sites, requests to conduct a personal franchise assessment, advertising and marketing materials, invitations to events and/or meetings, or social media interactions.

Further, due to the nature of the business Cookie Cutters conducts, by consenting, the individual allows Cookie Cutters to share the individual’s name and telephone number with Franchisors and other business partners with which Cookie Cutters and the individual may also conduct business. Every reasonable effort will be made by Cookie Cutters and/or its consultants to alert the individual that Cookie Cutters is sharing only their name and telephone number as a referral to a third party. Further, Cookie Cutters will direct the third party and/or other business partners to gain additional consent for such parties from the individual before sending any Commercial Electronic Message. Cookie Cutters is not responsible for ensuring those third parties collect consent from the individual for Commercial Electronic Messages in a manner appropriate for the law.

If the individual’s information collected needs to be updated or changed, the old information is deleted and new information must be voluntarily submitted.
Cookie Cutters will maintain a record of the individual’s contact information, including the date which the individual originally consented to receive information from Cookie Cutters or its consultants. At any time, the individual may opt-out of communications from Cookie Cutters by selecting the “Opt-out” option on any of the electronic communications, and all communications to the individual will cease.
